Trade Mark and Design Creation, Searches and Evaluation
Is a sign available for you to use and register as a trade mark or business name?
Has a similar or identical design to yours already been registered?
First, advice is provided on the creation of trade marks and designs. Some signs cannot be trade marks, for instance if they describe the goods or services. A design must meet various criteria to be registered.
Second, availability searches, whether national and/or international, should be undertaken before money has been spent on promotion, advertising and packaging.
A third party may already be using or have registered a similar trade mark or design. By searching on a variety of databases, in the UK and abroad, one can compare your trade mark or design with those that could conflict and assess the commercial risk of use and the likelihood of gaining a registration.
